LED brake light problem

My wife's 2019 Tucson Sport has a problem with the rear drivers side led brake light, mounted on the hatch. The brake light stays on if the running lights are on. Passenger side doesn't have this problem. I checked wiring and the running light wire has power and the brake light wire is dead until brake pedal is depressed. Seems like the $635.00 led assembly is bad. Anyone else heard of this problem? The dealer hasn't.
